LVNV

Sued By LVNV Funding in Broward or Miami-Dade County?

LVNV is a debt buyer that purchases old charged-off credit cards and consumer debts from other original debt owners.  Upon purchasing the old debts LVNV begins collection efforts including numerous phone calls to the debtor and the debtor’s family members and letters in the mail.

What Happen when LVNV Sues you in Florida

If you have received a summons and complaint from LVNV please do not ignore it, it means that you have been sued.  Once you have been served you have 20 days to respond in Florida.  If you fail to respond or if your court doesn’t accept your response you may have a default judgment entered against you.  Once a default judgment has been entered against you the creditor may be able to garnish your bank account or your wages.  We have handled numerous LVNV cases and these are the common defenses available against their lawsuit:

  • Can they prove they own the debt?
  • Has this debt already been settled?
  • Has the Statute of Limitation has Expired?
  • Was the debt discharged in a bankruptcy?
  • Are they suing the wrong party
