That experience allows Ofer to evaluate more than whether someone simply qualifies for bankruptcy. Every case requires careful consideration of the client’s assets, debts, income, goals, and potential risks before a bankruptcy case is filed.
For some clients, bankruptcy provides the best path forward. For others, defending a lawsuit or pursuing another solution may make more sense. Ofer’s goal is to help clients understand their options and make informed decisions based on their individual circumstances.
Debt Defense and Consumer Litigation
Ofer also represents Florida consumers who have been sued over credit cards and other consumer debts. These cases may involve original creditors, debt buyers, collection companies, and other entities attempting to collect allegedly unpaid accounts.
Debt collection lawsuits should not be treated as automatic judgments. Depending on the facts of the case, important issues may exist concerning the creditor’s evidence, ownership of the account, the amount claimed, applicable defenses, and compliance with state and federal law.
Ofer evaluates each case individually and works with clients to determine the most appropriate strategy, whether that means defending the lawsuit, negotiating a resolution, or considering bankruptcy when the client’s overall financial situation requires a broader solution.
Credit Report Errors and Consumer Rights
Ofer’s practice also includes representing consumers harmed by inaccurate information appearing on their credit reports.
Credit reporting errors can affect a person’s ability to obtain a mortgage, finance a vehicle, rent a home, or access other forms of credit. Problems can include accounts caused by identity theft, mixed credit files, inaccurate collection accounts, debts reported incorrectly after bankruptcy, and other information that credit bureaus or furnishers fail to correct after receiving notice of a dispute.
When appropriate, Ofer represents consumers in claims involving the Fair Credit Reporting Act and other consumer protection laws.

In 2021, Ofer received the Spirit of Justice Award alongside attorney Shera Anderson in recognition of their commitment to the work of the Legal Aid programs serving Broward County. Shmucher Law was later honored as Law Firm of the Year for its commitment to Legal Aid and the clients it serves.
