I had a recent bankruptcy consultation in my Miami Florida office and the client point blanked asked me why he should hire me rather than a bankruptcy preparer company that advertise on craigslist.  This wasn’t the first time that I’ve been asked this question by a potential client and it probably won’t be the last.    The easiest answer to this question is that when you use a preparation company ALL they are allowed to do is the type of the bankruptcy petition for the debtor.  You are basically paying for a typist.  A preparation company is NOT ALLOWED to give you any legal advise at all.  Meaning they can’t answer the following questions:

  • Whether someone should file for bankruptcy;
  • Which chapter of the Bankruptcy Code to file under;
  • What exemptions should be claimed or how exemptions work;
  • What a discharge of debt is and what kind of debts are/are not discharged;
  • Whether to redeem or reaffirm
  • Tax consequences of filing bankruptcy

Using a bankruptcy attorney you actually get someone who can answer your legal questions, give you legal advice, and appear in court with you.  It’s worth paying the money to hire a qualified bankruptcy lawyer.
