On a regular basis I have clients coming to Miami, Florida office telling me that they have attempted to modify their home mortgage but they have been rejected. In South Florida we have an MMM (Mortgage Modification Mediation) program through the bankruptcy court that allows the debtor to go to mediation in an attempt to modify the mortgage. Through the MMM program all documents are submitted through an an online portal so the bank can no longer say they haven’t received certain documents. This MMM program has been streamlined to reduce costs, save time, and make it easier for the parties to facilitate a loan modification. While there are no guarantees that a bank will provide the debtor with a modification, the banks are required to mediate on a good faith basis.
