Once a judgment is entered against a debtor, the creditor may attempt to try to collect on that judgment.  The first thing the creditor will likely do is require that the debtor complete a financial statement.   The creditor will ask the court to require that the debtor complete the fact information sheet within 45 days.   Clients have previously asked me if it is too late the file for bankruptcy once they have been given the fact information sheet.

A debtor can file for bankruptcy at any time during the collection process (before a judgment is issued, after a judgment has been issued, or even while the creditor is in the process of collecting on their judgment.

If you are thinking of filing for bankruptcy and would like to schedule a free consultation with an experienced bankruptcy attorney then please contact Shmucher Law, PL at 954.309.5559 or 305.741.5553.
